DamTrips Policy
Waiver & Release
This Waiver & Release (“Waiver”) applies to all bookings, trips, transportation services, pickup and drop-off activities, game day travel, related experiences, communications, and services provided by Oregon Experience Group LLC d/b/a DamTrips (“DamTrips,” “Company,” “we,” “us,” or “our”).
By checking the applicable box during checkout, clicking “Pay & Book,” making a booking, purchasing a trip, boarding a vehicle, participating in a DamTrips trip, or allowing any passenger in your party to participate, you acknowledge that you have read, understood, and agree to this Waiver, our Terms & Conditions, our Privacy Policy, and any trip-specific rules shown before purchase.
If you do not agree to this Waiver, do not book a trip, board a vehicle, or participate in a DamTrips trip.
1. Authority to Agree
You represent that you are at least 18 years old and have legal authority to enter into this Waiver.
If you make a booking for other passengers, you represent that you are authorized to accept this Waiver on behalf of yourself and all passengers in your party.
If you book for or accompany a passenger under 18, you represent that you are the passenger’s parent, legal guardian, or responsible adult authorized to agree to this Waiver and the Terms & Conditions on that passenger’s behalf.
If you book for or accompany a passenger under 21, you agree to supervise that passenger and ensure compliance with DamTrips’ passenger age rules, outside beverage rules, alcohol rules, safety rules, and all applicable laws.
2. Nature of the Trip
DamTrips provides game day transportation and related trip experiences. Transportation may be provided directly by DamTrips or through licensed third-party motor coach, charter, transportation, or event vendors.
A DamTrips trip may include travel to and from sporting events or other destinations, pickup and drop-off at third-party locations, loading and unloading, walking to and from pickup points, vehicle boarding and exiting, interaction with other passengers and members of the public, stadium or venue activity, and other trip-related activities.
You understand that DamTrips is an independent transportation and travel experience company and is not owned, operated, sponsored, endorsed, or controlled by any university, athletic department, conference, venue, team, ticketing company, transit agency, hotel, or government entity unless expressly stated otherwise in writing.
3. Assumption of Risk
You understand and acknowledge that travel, transportation, large events, sporting events, parking areas, roadways, sidewalks, loading zones, pickup stops, drop-off locations, public areas, private property, and group activities involve inherent and unavoidable risks.
These risks may include, but are not limited to:
- traffic accidents;
- vehicle movement, sudden stops, turns, braking, or road conditions;
- slips, trips, and falls;
- boarding and exiting risks;
- stairs, ramps, curbs, uneven pavement, gravel, wet surfaces, low lighting, and crowded areas;
- weather exposure, including heat, cold, rain, wind, smoke, ice, or poor air quality;
- traffic delays, road closures, detours, law enforcement activity, or event-related congestion;
- crowd activity, public conduct, intoxicated persons, disorderly conduct, or criminal acts by third parties;
- personal injury, illness, dehydration, fatigue, motion sickness, allergic reactions, or medical events;
- lost, stolen, damaged, or misplaced personal property;
- vehicle damage, theft, vandalism, towing, or parking citations at pickup or drop-off locations;
- acts or omissions of other passengers, members of the public, venues, property owners, transit agencies, hotels, parking operators, transportation providers, drivers, vendors, security personnel, law enforcement, or other third parties;
- delayed arrival, delayed departure, missed event time, missed post-game departure, or missed connections;
- risks related to outside beverages, alcohol-related conduct, intoxication, impairment, or passenger misconduct; and
- other known or unknown risks that may arise before, during, or after the trip.
You voluntarily accept and assume all risks associated with booking, boarding, riding, participating in, waiting for, walking to or from, or otherwise taking part in a DamTrips trip.
4. Release of Claims
To the fullest extent permitted by law, you, on behalf of yourself, your heirs, executors, administrators, personal representatives, successors, assigns, family members, dependents, and any passengers for whom you book or are responsible, release, waive, discharge, and agree not to sue Oregon Experience Group LLC d/b/a DamTrips and its owners, members, managers, officers, employees, contractors, vendors, affiliates, representatives, agents, insurers, successors, and assigns from any and all claims, demands, damages, losses, liabilities, costs, expenses, actions, or causes of action arising out of or related to:
- your booking;
- your participation in a DamTrips trip;
- transportation to or from an event;
- loading, unloading, boarding, or exiting a vehicle;
- pickup or drop-off activities;
- use of third-party pickup locations, park-and-ride lots, hotels, parking areas, transit facilities, sidewalks, roadways, or venue areas;
- missed departures, late arrivals, or failure to board or re-board;
- event delays, kickoff changes, schedule changes, traffic, road closures, weather, or operational changes;
- outside beverages, alcohol-related conduct, intoxication, impairment, or denied boarding or re-boarding;
- actions, omissions, or conduct of other passengers or third parties;
- loss, theft, damage, or destruction of personal property;
- vehicle damage, towing, parking citations, or incidents occurring at third-party pickup or drop-off locations;
- personal injury, illness, disability, emotional distress, inconvenience, or death; and
- any other claim arising from risks associated with the trip.
This release includes claims based on ordinary negligence to the fullest extent permitted by law.
This Waiver does not release claims that cannot legally be released under applicable law.
5. Third-Party Transportation Providers, Pickup Locations, and Vendors
You understand that DamTrips may use third-party transportation companies, motor coach operators, drivers, parking operators, hotels, transit-related pickup locations, ticket providers, restaurants, technology providers, payment processors, and other vendors.
You acknowledge that these third parties are independent from DamTrips unless expressly stated otherwise in writing.
To the fullest extent permitted by law, you release DamTrips from claims arising out of or related to the acts, omissions, delays, failures, negligence, policies, restrictions, property conditions, or services of third-party transportation providers, drivers, venues, hotels, transit agencies, property owners, parking operators, ticket providers, restaurants, technology providers, payment processors, or other vendors.
You understand that DamTrips does not own, operate, control, secure, patrol, manage, or supervise third-party pickup or drop-off locations unless expressly stated in writing.
You agree that DamTrips, the property owner, transit agency, hotel, parking operator, and any pickup-location partner are not responsible for theft, vandalism, towing, parking citations, vehicle damage, personal injury, lost property, weather exposure, criminal acts, accidents, slips, falls, or other incidents occurring before boarding, after deboarding, while waiting for the bus, while walking to or from the bus, or while using any parking area or pickup location, except to the extent otherwise required by law.
6. Passenger Conduct, Intoxication, and Denied Transportation
You agree to behave safely and respectfully at all times and to follow all instructions from DamTrips staff, guides, drivers, transportation providers, venue personnel, law enforcement, emergency personnel, and pickup-location personnel.
You understand that DamTrips may deny boarding, deny re-boarding, remove, or refuse further transportation to any passenger who appears intoxicated, impaired, disruptive, unsafe, abusive, threatening, noncompliant, unable to follow instructions, or in violation of DamTrips rules, the Terms & Conditions, or applicable law.
If you or a passenger in your party is denied boarding or re-boarding due to intoxication, impairment, misconduct, failure to follow instructions, or violation of DamTrips rules, you understand and agree that DamTrips will have no obligation to provide return transportation, arrange alternative transportation, reimburse alternative transportation, provide lodging, provide a refund, provide a credit, or provide any other compensation.
You are responsible for arranging your own transportation if you are denied boarding or re-boarding.
7. Outside Beverages and Alcohol-Related Risks
You understand that DamTrips does not sell alcohol. DamTrips does not serve, furnish, distribute, or provide alcoholic beverages to passengers.
If limited outside beverages are permitted on a trip, you agree to follow all DamTrips outside beverage rules, including the limit of two canned beverages per guest, the requirement that outside beverages be commercially sealed and unopened at boarding, the prohibition on glass containers, flasks, liquor bottles, mixed-drink containers, open cups, unsealed containers, kegs, drinking-game equipment, or loose alcohol containers, and the requirement that all outside beverages be disposed of before deboarding at the stadium or event destination.
You understand that outside beverages may not be left, stored, saved, held, or secured on the bus during the game or event. You understand that outside beverages may not be brought back onto the bus after the game or event and may not be consumed on the return trip.
If an outside beverage contains alcohol, the passenger possessing it must be at least 21 years old and must present valid government-issued photo identification upon request.
You agree that no passenger under 21 may possess, open, handle, or consume alcohol. You agree not to provide alcohol to any person under 21.
You acknowledge and assume all risks associated with outside beverages, alcohol-related conduct, intoxication, impairment, passenger misconduct, denied boarding, denied re-boarding, disposal of outside beverages, and compliance with alcohol-related laws and policies.
8. Accessibility and Medical Responsibility
You are responsible for providing accurate accessibility, mobility, medical, and passenger assistance information during checkout or by contacting DamTrips before the trip.
You understand that DamTrips will make reasonable efforts to coordinate accessibility accommodations consistent with applicable law and operational feasibility.
You are responsible for your own health, medications, mobility devices, medical needs, service animal needs, ability to board and ride safely, and ability to participate in the trip.
You agree that DamTrips is not responsible for medical care, medication administration, personal care assistance, or emergency medical treatment.
If you experience a medical emergency or safety concern, DamTrips may contact emergency services, law enforcement, venue personnel, or other appropriate third parties.
9. Personal Property
You are responsible for your own belongings at all times.
To the fullest extent permitted by law, DamTrips is not responsible for lost, stolen, damaged, misplaced, or unattended property, including phones, wallets, bags, clothing, tickets, IDs, keys, beverages, merchandise, vehicles, or items left on the bus, at a pickup location, at a stadium, or with another passenger.
You understand that DamTrips is not responsible for storing, safeguarding, returning, replacing, or reimbursing any outside beverage, prohibited item, or personal item.
10. Indemnification
You agree to defend, indemnify, and hold harmless DamTrips and its owners, members, managers, officers, employees, contractors, vendors, affiliates, representatives, agents, insurers, successors, and assigns from and against any claims, damages, losses, liabilities, fines, penalties, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:
- your violation of this Waiver;
- your violation of the Terms & Conditions;
- your conduct or misconduct;
- your violation of law;
- your damage to property;
- your injury to another person;
- your booking for or actions of passengers in your party;
- your alcohol, substance, outside beverage, or prohibited-item related conduct;
- your use of a third-party pickup, drop-off, parking, hotel, transit, or venue location;
- your failure to follow instructions from DamTrips, the driver, the transportation provider, law enforcement, venue personnel, emergency personnel, or pickup-location personnel; or
- any claim brought by a passenger in your party, including a minor or under-21 passenger, arising out of or related to the trip.
11. Medical Treatment and Emergency Assistance
In the event of an emergency, injury, illness, suspected intoxication, impairment, or safety issue, you authorize DamTrips to contact emergency medical services, law enforcement, venue security, emergency contacts, transportation providers, or other appropriate third parties.
You understand that DamTrips does not provide medical services and is not responsible for the cost, availability, quality, or outcome of emergency medical care, ambulance transportation, medical treatment, or related services.
You are responsible for any medical, ambulance, emergency, or related expenses incurred by you or passengers in your party.
12. No Guarantee of Arrival Time or Event Attendance
You understand that traffic, road conditions, weather, road closures, vehicle issues, driver availability, passenger loading, law enforcement activity, event operations, and other factors may affect departure times, arrival times, and return times.
DamTrips does not guarantee arrival before kickoff, before a specific event time, before stadium entry cutoff, or before any specific portion of the event.
You release DamTrips from claims related to delayed arrival, delayed departure, missed kickoff, missed event time, missed seat time, missed post-game departure, or dissatisfaction with the event experience, except to the extent such release is prohibited by law.
13. Limitation of Liability
To the maximum extent permitted by law, DamTrips and its owners, members, managers, officers, employees, contractors, vendors, affiliates, representatives, agents, insurers, successors, and assigns will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost opportunities, missed events, emotional distress, inconvenience, lodging costs, airfare, rideshare costs, meals, parking costs, vehicle damage, towing costs, medical costs, or other third-party expenses.
To the maximum extent permitted by law, DamTrips’ total liability for any claim related to a booking, trip, or service will not exceed the amount you paid directly to DamTrips for the affected booking.
Nothing in this Waiver limits liability where such limitation is prohibited by law.
14. Governing Law and Venue
This Waiver is governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
Unless otherwise required by law, any dispute arising out of or related to this Waiver, the website, a booking, or a trip will be brought in the state or federal courts located in Oregon, and you consent to the jurisdiction of those courts.
15. Severability
If any part of this Waiver is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
If any release, waiver, limitation, or indemnity is found to be overly broad, it shall be enforced to the maximum extent permitted by law.
16. Acknowledgment
By checking the applicable box during checkout, clicking “Pay & Book,” making a booking, purchasing a trip, boarding a vehicle, participating in a DamTrips trip, or allowing any passenger in your party to participate, you acknowledge and agree that:
- you have read this Waiver;
- you understand this Waiver;
- you understand that this Waiver affects legal rights;
- you voluntarily agree to this Waiver;
- you accept and assume the risks described in this Waiver;
- you agree to release certain claims to the fullest extent permitted by law;
- you have authority to agree for yourself and for passengers in your party; and
- you agree that this Waiver applies to your booking, trip, transportation, pickup and drop-off activities, and related services.
